These Terms of Service (“Terms”) form a binding agreement between you and CommandIT LLC, a Florida limited liability company (“CommandIT,” “we,” “us,” or “our”), governing your use of commandyourtech.com (the “Site”), the Fix-IT-Bot mobile application (the “App”), and any remote or in-home tech support services we provide (together, the “Services”).
If you do not agree to these Terms, do not use the Services.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to book paid services or create a Fix-IT-Bot account. By using the Services, you represent that you meet these requirements.
If you are booking services on behalf of a household member, business, or another person, you represent that you are authorized to do so and to grant us access to the affected devices and networks.
3. Description of Services
Remote support: Available to customers located in the State of Florida. Sessions are delivered through AnyDesk or equivalent remote access software. Flat rate per session is $80, unless otherwise stated at booking.
In-home support: Available only in Broward County and Miami-Dade County, Florida. Flat rate per visit is $90, unless otherwise stated at booking. Additional trip fees may apply outside our standard service area and will be disclosed before booking.
Fix-IT-Bot App: A self-service diagnostic tool available free of charge, with an optional Fix-IT-Bot Pro subscription at $4.99 per month that unlocks additional features described in the App.
Knowledge base: Articles and diagnostic guides on the Site are provided for informational purposes only. They are not a substitute for professional tech support.
ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. We will apply reasonable professional effort to diagnose and resolve your issue, but we do not guarantee that every issue can be resolved.
4. Booking, Scheduling, and Service Area
Appointments are booked through Square Appointments. You will receive email confirmation and reminder messages from Square on our behalf. Remote sessions are typically available on weekends; in-home visits are scheduled by appointment.
We reserve the right to decline or reschedule any booking, including bookings that fall outside our service area, involve regulated industries we do not serve, or raise safety or compliance concerns. If we decline, any amount paid will be refunded in full.
5. Scope of Work and What We Do Not Do
Our Services cover consumer and small-business technology support such as Wi-Fi, printers, smart home devices, personal computers, mobile devices, email setup, and common software issues.
We do not provide services involving:
- Medical, legal, or financial regulated data systems (HIPAA, legal privilege, PCI cardholder environments, or similar regulated infrastructure).
- Enterprise server administration, domain controller work, or managed IT contracts with SLAs.
- Hardware repair involving soldering, board-level work, or replacement of internal components on laptops, phones, game consoles, or similar devices.
- Data recovery from physically failed storage devices.
- Illegal content, pirated software, circumvention of digital rights management, or anything that violates applicable law or platform terms.
We are an independent tech support provider. We are not affiliated with, endorsed by, or authorized service providers for Apple, Microsoft, Google, Samsung, Amazon, or any other manufacturer unless expressly stated in writing.
6. Payment
Payment is collected at the time of booking through Square. By booking, you authorize Square to charge your selected payment method for the full amount of the service plus any applicable taxes.
Quoted flat rates cover the standard session length. Additional work outside the original scope will be quoted and charged only with your express approval.
Fix-IT-Bot Pro is billed monthly at $4.99 through the Google Play Store or Apple App Store. Subscription management, renewal, and cancellation are handled through the platform where you subscribed.
7. Refunds and Cancellations
Our full Refund Policy is incorporated into these Terms by reference. Summary:
- Cancel 24+ hours before your appointment: full refund.
- Cancel less than 24 hours before: 50 percent refund.
- No-show: no refund.
- Session completed but issue not resolved: 50 percent diagnostic credit valid for 90 days, or 50 percent cash refund at our discretion.
- Fix-IT-Bot Pro: cancel anytime to stop future billing. The current billing month is non-refundable except that a full refund is available within 7 days of the first charge on a new account.
Refunds are processed through Square and typically appear on your original payment method within 5 to 10 business days.
8. Remote Access Consent
To receive remote support, you will be asked to install AnyDesk and provide us with a one-time session code. By providing the code and accepting the connection prompt, you consent to allow our technician to view and control the designated device for the duration of the session. You may terminate the session at any time by closing AnyDesk or disconnecting from the network.
You agree to close any personal, confidential, or sensitive applications and documents before the session begins. We are not responsible for exposure of information left open on your screen during a remote session.
9. Your Responsibilities
- Back up your data before any support session. You are solely responsible for your backups.
- Provide accurate information about your devices, accounts, and the issue.
- Ensure you have the legal right and authority to grant access to the devices, networks, and accounts involved.
- Supervise any service performed in your home and ensure a safe working environment.
- Keep your Fix-IT-Bot account credentials confidential and notify us immediately of any unauthorized use.
10. Knowledge Base and Fix-IT-Bot Disclaimer
The knowledge base, diagnostic guides, Fix-IT-Bot App responses, and any AI-generated suggestions are provided for general informational purposes. They are not a substitute for professional judgment, and following them is at your own risk. If a step could cause data loss, bricking, or warranty impact, stop and book a technician.
11. Intellectual Property
All content on the Site and within the App, including text, images, logos, knowledge base articles, the Fix-IT-Bot name and mascot, and software, is owned by CommandIT LLC or its licensors and is protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Site and App for personal, non-commercial use consistent with these Terms. You may not copy, scrape, republish, train AI models on, or commercially exploit our content without our prior written consent.
12. Acceptable Use
You agree not to:
- Use the Services for any unlawful, harmful, fraudulent, or abusive purpose.
- Attempt to gain unauthorized access to the Site, App, or any related systems.
- Interfere with or disrupt the integrity or performance of the Services.
- Harass, threaten, or abuse our staff during any session or communication.
- Request assistance with activities that violate applicable law or third-party terms.
We may suspend or terminate your access to the Services for any violation of these Terms.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, SITE, APP, AND KNOWLEDGE BASE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION.
WE DO NOT WARRANT THAT EVERY ISSUE WILL BE RESOLVED, THAT THE SERVICES WILL BE ERROR-FREE, OR THAT ANY SPECIFIC OUTCOME WILL BE ACHIEVED.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMANDIT LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, OR HARDWARE FAILURE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO COMMANDIT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless CommandIT LLC and its members, managers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any content, device, network, or account you gave us access to.
16. Governing Law and Venue
These Terms and any dispute arising out of them are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to the arbitration clause below, the exclusive venue for any permitted court action shall be the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction in those courts.
17. Mandatory Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for small claims court matters and claims for injunctive relief to protect intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in Broward County, Florida, or by videoconference at the arbitrator’s discretion. Judgment on the award may be entered in any court of competent jurisdiction.
YOU AND COMMANDIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class proceeding.
You may opt out of this arbitration agreement by emailing support@commanditllc.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
18. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, hurricanes, floods, power or internet outages, labor disputes, cyber incidents, acts of government, or supplier failures.
19. Termination
We may suspend or terminate your access to the Site, App, or Services at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Arbitration.
20. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a new “Last updated” date. Material changes will be announced on the Site or by email. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
21. Entire Agreement and Severability
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CommandIT regarding the Services and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
